Navi Mumbai: An FIR was filed against unidentified persons by the CBD-Belapur police following a Belapur court order taking suo motu cognisance of a forged interim order giving temporary relief to an unauthorised ground-plus-five-storey structure in Sarsole village, Nerul. The Navi Mumbai Municipal Corporation served a notice in April this year to the 600-sq-m constructed building.The NMMC had served the notice to the petitioner, Bebibai Thakur, under Section 54 of the Maharashtra Regional Town Planning Act, alleging that the structure had been erected without obtaining requisite permission from the planning authority. Cidco is a respondent to the petition.NMMC counsel, advocate Shailesh Yadav, sought a hearing in the case and produced a PDF file purportedly containing a certified copy of the complaint and the interim order. The municipal commissioner received the PDF file from a mobile number through WhatsApp.The interim order mentions, “It is a temporary relief only till the next date of hearing. On the next date, the court may continue, modify or vacate the protection depending on documents and arguments.” However, NMMC advocate Yadav pointed out that no such interim order was passed by the court and also no interim protection was granted.Judge Vinayak Vishwas stated that an unknown person fabricated and manipulated a judicial order and thereby committed fraud upon NMMC and the court. The judge has directed the assistant superintendent (judicial) to take criminal action by lodging a complaint with the police. The court order on the suo motu petition has been attached to the police complaint.Belapur police have lodged the FIR under cheating, forgery, forgery of court records, among relevant sections of the BNS. Further investigation is ongoing.
