Jharkhand high court stays cancellation of six Upper Bazaar shops’ trade licences

Chandrajit MukherjeeRanchi: Jharkhand high court on Tuesday clamped a stay on the operation of a directive of the Ranchi Municipal Corporation cancelling the trade licences of six shops in Upper bazaar.The court of Justice Ananda Sen was hearing a petition filed by the six shopkeepers led by Messrs Deepali Marketing who have challenged the notice issued by the civic authority cancelling their trade licences.The corporation had issued notices to the shopkeepers for allegedly running their businesses without complying with the directives of the civic body.Notices were issued to the shopkeepers without asking them for a show cause, which is a violation of natural justice, the counsel for the petitioners pleaded before the high court.The shopkeepers, while approaching the high court, said that no prior show-cause was served upon them to seek an explanation for the violations alleged by the corporation. The HC, after hearing the matter, issued notice to the corporation to file its response within four weeks, during which time the operation of the notice will remain stayed.
