Patna: Taking serious note of repeated delays by the Rohtas superintendent of police (SP) in complying with its orders, a court in Sasaram has directed the institution of a separate criminal miscellaneous case against the officer.District Judge-IV Anil Kumar, in an order passed on Monday, observed that repeated non-compliance and delayed compliance of judicial directions could not be ignored. The court also issued a notice to the SP, directing him to appear personally or through counsel on Aug 22 and explains the reasons behind the delays.The matter pertains to Sessions Trial Case No. 95/2023 arising out of Darigaon police station case No. 183/2022. According to the order, the court had delivered its judgement on Aug 30, 2025, and subsequently issued D O Letter No. 216 on Sept 2, 2025, directing the Rohtas SP to register an FIR against the victim and the informant.However, the FIR was registered only on July 19, 2026, nearly 10 months after the court’s direction.The court also cited another instance of delayed compliance. On July 3, 2026, it had sought an explanation within three days, but the reply was submitted only on July 23, 20 days after the stipulated deadline.Similarly, in an order dated July 16, 2026, the court directed that a report be sent to the Bihar DGP and the chief secretary recommending disciplinary action and sought a status report within 15 days. The court noted that no response had been received even after 30 days.Observing that no satisfactory explanation had been furnished for the delay in registering the FIR, the court said the conduct reflected “indifference on the part of the executive” and amounted to disregard for the authority of the judiciary.The court further said stringent action had become necessary to uphold the dignity of the judiciary and the rule of law. It accordingly ordered the institution of a separate criminal miscellaneous case against the Rohtas SP and issued a notice for his appearance on Aug 22.
