Patna: The Patna high court has held that payment of interim maintenance to a wife cannot be imposed as a precondition for granting anticipatory or regular bail to a husband accused of matrimonial cruelty and dowry demand. A single bench of Justice Raj Kumar passed the order on Sept 1 while allowing the regular bail plea of Amarjeet Kumar, who had been in custody for seven months in connection with a complaint filed by his wife, Durgawati Devi, before a local magisterial court in Sasaram, Rohtas district.The high court, however, directed Amarjeet to appear before the family court in Sasaram on the date fixed for hearing in the maintenance case filed by his wife.
